Three Common Real Estate Problems

Buying a home or commercial property can be one of the most important decisions of your life. Real estate deals can go wrong, resulting in stressful and expensive litigation.

Here are three common real estate issues:

1. Breach of Contract

Many real estate deals use forms from the California Association of Realtors. These forms have a lot of check boxes and small print. The small print includes important details such as descriptions of the property, closing dates, assets, and more. The small print can be overwhelming and difficult to understand. If one side of the contract does not live up to their terms of the contract, this can result in a lawsuit and litigation.

2. Failure to Disclose

A seller must disclose known information that may affect the value of property. The buyer must still do their due diligence and investigate the property. If a seller fails to disclose information and the buyer later learns about a defect in the property, this can result in a lawsuit and litigation.




3. Breach of Fiduciary Duty or Negligence by the Real Estate Agent

Real estate agents must act in their clients’ best interests. The real estate agent should keep information confidential, be loyal, and act in good faith. A conflict often can arise if the real estate agent represents both the buyer and the seller. If a real estate agent breaches their fiduciary duty or was negligent, this can result in a lawsuit and litigation.
