January 16, 2024, Poway, California - Garcia Hong Law and co-counsel Law Office of Derek J. Wilson prevailed on opposing a commercial property owner's attempt to get rid of their client's wrongful death action. The commercial property owner argued it owed no duty to a pedestrian crossing through the alleyway of its Poway strip mall. The Court found it was foreseeable that both trucks and pedestrians would access the same alleyway. The Court found that there was a dispute as to the minimal burden on the commercial property owner to protect against the harm of pedestrians vs. truck accidents.
On March 3, 2021, Adelaida San Miguel was fatally struck by a commercial truck in the alleyway of a Poway strip mall. She is survived by her loving daughter, family, and friends who cared so much for Adelaida.
